Constitution of Tartaria
Constitution of Tartaria is under construction.
Preamble
We, the Pahans of the Farms of Tartaria, in order to stop the endless fighting, to shut down the disaster known as Bigpuf, fix the following compulsory rules.
We promise to follow them.
I. FOUNDATIONS
Article 1. Definition of Tartaria
1. Tartaria is a union of autonomous entities (“Farms”).
2. A Farm is any territory that:
(a) accepts this Constitution,
(b) is recognized by all existing Farms.
3. The Constitution does not define number, names, or size of Farms.
4. Borders are listed in the Appendix.
No Farm’s border may be changed without its consent.
5. Borders may be adjusted by mutual agreement based on referendums.
Claims based on history, race, religion, or morality are void.
6. Free movement is allowed across Tartaria.
No internal tariffs.
External tariffs only in case of war.
Article 2. Supremacy
1. This Constitution overrides everything.
2. Any contradiction makes the lower rule void.
Article 3. Prohibitions
The following are forbidden:
1. Unauthorized aggression causing irreversible damage
2. Robbery
3. Fraud
4. Interference with recording
5. Destruction or hiding of records
6. Non-justified discrimination with respect to age, morphology or religion.
Article 4. Observability
1. All relevant actions must be recordable.
2. Records must not be hidden or altered.
3. Surveillance is total and mandatory.
4. There is no privacy.
Article 5. Truth and Evidence
1. Truth comes from records.
2. No record → no truth.
3. Interpretation must follow observable context.
Article 6. Responsibility
1. Every action must have an identifiable agent.
2. Anonymous influence is forbidden.
3. Responsibility sticks unless explicitly transferred.
II. ONTOLOGY (WHAT EXISTS)
Article 7. Property
1. Property exists only if:
(a) declared,
(b) protected.
2. Only protected property exists legally.
3. Undeclared property is free for taking.
Article 8. Taxation
1. Income tax is forbidden.
2. Only protected property is taxed.
3. Protection requires payment.
4. The taxation rules must be specified in the pre-elective program of Pahan and cannot be increased after the program by Pahan is submitted.
5. Taxation of any property cannot increase more than twice due to the change of Pahan.
Article 9. Contracts
1. Contracts are binding.
2. Enforcement is mandatory.
3. A body and freedom may be used as collateral.
Article 10. Status of Individuals
1. An Individual may transfer freedom by contract.
2. Such Individual becomes Property.
3. Status may be restored if contract conditions are fulfilled.
Article 11. Information
1. All information is free.
2. Any restriction or distortion is fraud.
Article 12. No Silent Reinterpretation
No symbol, record, or contract may change meaning silently.
III. MECHANICS
Article 13. Property Valuation System
1. Protected property must have a declared value.
2. Administration evaluates value.
3. Owner may:
(a) surrender property to the administration for 50% of evaluated value; then the administration must pay this amount.
(b) declare lower value (to reduce the tax)
(c) declare higher value (to avoid acquire below )
4. If declared lower, then Administration may acquire at 200% of declared value.
5. Any citizen may acquire at 400% of the highest value.
6. Value cannot be changed within 24 hours after transfer.
Article 14. Anti-Concealment Principle
Hidden assets are treated as unprotected.
Article 15. Enforcement
1. Enforcement may be automated.
2. Interference in the Legal procedure is a crime.
IV. GOVERNANCE
Article 16. Courts
1. Courts enforce and interpret.
2. Types:
(a) Lynch courts
(b) National courts
(c) Federal court
3. Decisions rely on records.
Article 17. Elections of Pahans
1. Each Farm elects its Pahan.
2. Fixed terms.
3. Maximum two consecutive terms.
4. Must execute declared program.
5. Failure = fraud.
Article 18. Elections of Judges
1. Federal judges: limited terms.
2. National judges: unlimited term.
3. Removal by Federal Court for violations.
Article 19. President
1. Approved by all Pahans.
2. Maximum two terms.
3. Coordinates federal actions.
Article 20. Impeachment
Removal if:
1. Constitution violation confirmed.
2. Decisions contradict records.
Article 21. Mandatory Institutions
Federal and National levels must maintain:
Federal also maintains:
- Army
- Federal Junta
All must be fully observable.
Article 22. Administrative Autonomy
1. Institutions act without constant approval by Pahan.
2. Artificial dependency = usurpation, crime.
V. PROCESSES
Article 23. Referendums
Required for:
1. Admission of a new Farm
2. Exclusion of a farm
3. Change of borders between farms
4. Constitution changes
Article 24. Election Committees
1. Appointed by Pahan.
2. Appointer cannot run.
3. Full responsibility for system integrity.
Article 25. Voting Mechanism
1. Options: Yes / No / Do not know
2. Votes may be changed until closure.
3. All votes and their history are recorded and public.
Article 26. Referendum Completion
Ends when:
1. 75% participation reached
2. 75% approval sustained for 240 hours
Article 27. Elections
1. Candidates exceed positions.
2. Lowest candidates removed over time.
3. Full voting history is visible.
Article 28. Federal Referendums
1. Must pass in all Farms.
2. Exception: exclusion case; then all farms minus one.
Article 29. Validity of Questions
1. Must be clear and lawful.
2. Manipulation = fraud.
VI. STATUS SYSTEMS
Article 30. Citizenship
1. Every Tartarian is citizen of one and only one Farm.
2. Citizen can be granted by the Pahan and/or Administration and/or Courts
3. Responsibility shared by grantors.
Article 31. Citizenship Revocation
1. Voluntary with delay.
2. By court if needed.
3. Lost if Individual becomes Property.
Article 32. Refugees
1. All entrants accepted.
2. Classified as visitors, guests, refugees, or criminals.
3. Refugees go to Trulag.
4. Criminals go to Contslag.
5. By default, all entrants except criminals may leave from Tartaria.
Article 33. Newborns
1. Assigned identity at birth.
2. Ownership defaults to Creator.
3. If Creator is Property → ownership transfers.
Article 34. Ownership of Individuals
1. Must be explicit and recorded.
2. May be collective.
3. State cannot own Individuals.
Article 35. Owners and Dependents
1. Owner is responsible for the Dependent(s).
2. Dependents cannot own property.
3. Abuse leads to loss of rights.
Article 36. Release
1. 7 years of honest work → release.
2. Status decided by court.
Article 37. Territorial Limit
Ownership valid only inside Tartaria.
Escape ends enforcement.
VII. FORCE AND FAILURE
Article 38. Army
1. Volunteers only.
2. Each volunteer chooses his/her/its Commander.
3. Commanders are controlled by Federal Junta.
4. Every Tartarian may own any weapon and use it for self-defence and/or for support of the Army if required by order of his/her/its Commander.
5. Use of non-selective weapon for self-defence may form a crime is innocent people are affected.
6. Execution of an order of Commander form crime if the order contradicts this Constitution.
Article 39. War
1. War = failure of leadership.
2. Leaders pay for consequences.
3. Investigated after war.
Article 40. Defense of Constitution
1. Every Tartarian may defend it.
2. Escalation: report → protest → resistance → Civil war
3. The last does not form the crime if and only if:
(a) The claims of the Tartarian are supported with evidence(s) and
(b) All the more civilized ways to recover the conditions of this Constitution had failed.
Article 41. Failure of System
If contradictions cannot be resolved even with the civil war, then:
2. Tartaria is dissolved.
2. A new system may replace it.
Article 42. Final Clause
This Constitution exists only while it prevents collapse.
If it fails — discard it.
